Attorney General Ken Paxton has secured a court agreement that prevents the Biden Administration from disposing of border wall materials. This decision was reached during a hearing requested by Paxton to investigate potential legal violations by the outgoing administration, following reports of border wall segments being sold at low prices.
The Biden Administration agreed in court to halt any further disposal of these materials for 30 days. This pause allows President-elect Donald Trump to utilize the materials according to his plans once he assumes office. The agreement will be formalized as a court order, ensuring enforceability against any breaches.
The court also confirmed that Texas is entitled to documentation verifying compliance with an injunction obtained by Attorney General Paxton in May 2024. This injunction required the federal government to allocate funds for border wall construction, which had been previously redirected. Any proven disposal of materials purchased with these funds or misrepresentations by the Department of Justice could lead to sanctions and contempt charges.
“We have successfully blocked the Biden Administration from disposing of any further border wall materials before President Trump takes office,” stated Attorney General Paxton. “This follows our major victory forcing Biden to build the wall, and we will hold his Administration accountable for illegally subverting our Nation’s border security until their very last day in power, especially where their actions are clearly motivated by a desire to thwart President-elect Trump’s immigration agenda.”
