Rutherfordton man sentenced to prison for illegal firearm possession

Kailyn Leroy Flack, a 29-year-old resident of Rutherfordton, North Carolina, has been sentenced to 92 months in prison followed by three years of supervised release for possession of a firearm by a felon. The announcement was made by Dena J. King, U.S. Attorney for the Western District of North Carolina.

Court documents reveal that on September 26, 2022, probation officers were searching for Flack after he removed his electronic ankle monitor while on state probation for a drug trafficking conviction. Upon arriving at his residence and finding his vehicle with doors open, officers waited nearby for backup. Flack approached them in his vehicle and was arrested. A search revealed a handgun holster on him and multiple firearms in his vehicle, including several reported stolen.

Flack was found guilty on June 27, 2024, following a bench trial and is currently in federal custody awaiting transfer to the Federal Bureau of Prisons.

The investigation involved the Bureau of Alcohol, Tobacco, Firearms and Explosives; the North Carolina Department of Public Safety’s Division of Community Supervision; and the Rutherford County Sheriff’s Office. The case was prosecuted by Assistant U.S. Attorney Don Gast and Special Assistant U.S. Attorney Annabelle Chambers from Asheville's U.S. Attorney’s Office.

Chambers serves as SAUSA through collaboration between the office of the 43rd Prosecutorial District and the United States Attorney’s Office to ensure effective prosecution within those counties.

This case is part of Project Safe Neighborhoods (PSN), aimed at reducing violent crime and gun violence through community trust-building initiatives launched on May 26, 2021.
