Attorney General opens probe into civilian death at Marcy Correctional Facility

The New York Attorney General's Office of Special Investigation (OSI) has initiated an investigation into the death of Robert Brooks. Brooks died on December 10, 2024, after an encounter with officers from the New York State Department of Corrections and Community Supervision at Marcy Correctional Facility in Oneida County.

On December 9, following a use of force by correction officers, Brooks, who was incarcerated at Marcy Correctional Facility, was taken to a local hospital. He was pronounced dead in the early morning hours of December 10.

According to New York State Executive Law Section 70-b, OSI reviews every incident reported where a police officer or peace officer, including corrections officers, may have caused a person's death through action or omission. The law applies whether the officer is on-duty or off-duty and regardless of whether the deceased was armed or unarmed. It also considers cases where the decedent may or may not be in custody or incarcerated. If OSI’s assessment suggests an officer may have been responsible for the death, it proceeds with a full investigation.
