The Vermont Supreme Court's Advisory Committee on Rules for Public Access to Court Records has scheduled a meeting for November 22, 2024. The agenda includes discussions on potential amendments to existing rules and the status of various court orders.
Chair Tomasi will commence the meeting with announcements and general discussion. The committee is set to approve minutes from its September 13, 2024 meeting.
A significant topic on the agenda is possible amendments to Rules 7(a)(3) and 7(a)(4)(B). These rules concern efforts to correct or redact civil filings that have been made public without prior court review, following a case involving Courthouse News. The appeal in this case was argued in April 2023, and any updates are awaited as it progresses through the Second Circuit.
Another key item involves examining the public-access status of inquests, subpoenas duces tecum, and nontestimonial orders. Chair Tomasi had previously mentioned plans to collaborate with the Criminal Rules Committee on this issue. Additionally, there will be a replacement for Ms. Shriver on a subcommittee.
Annual updates to Appendices PACR Rules 5 and 6 will also be reviewed during this session. The meeting will conclude with new business discussions and setting a date for the next gathering.
