The Maryland Judiciary has announced an extension of its Phase II operations in response to the ongoing surge in COVID-19 cases across the state. This decision will keep Phase II operations active through March 14, 2021, as part of a five-phased reopening plan designed to adapt to pandemic conditions. Chief Judge Mary Ellen Barbera of the Maryland Court of Appeals issued several administrative orders, including one that extends the suspension of jury trials until April 23, 2021.
Chief Judge Barbera stated, “The surge in COVID-19 cases during November is expected to be sustained through the winter, making it necessary for the Maryland Judiciary to remain in Phase II of its operations plan.” She emphasized that court operations would continue to adjust as needed to protect public health while maintaining essential judicial functions.
Initially, full court operations had resumed on October 5, 2020. However, due to rising COVID-19 cases, restrictions were imposed again with a move back to Phase III on November 16 and then further limited to Phase II by November 30.
Administrative orders detailing these changes are available on the Maryland Judiciary’s website. They include measures such as restricting statewide judiciary operations and suspending certain legal processes like foreclosures and evictions during the emergency period.
Under Phase II guidelines, specific case types may be heard remotely or in-person at district and circuit courts throughout Maryland. Jury trials remain suspended until conditions allow a return to full operational capacity under Phase V. The use of technology for remote hearings continues across different court locations.
