Arizona AG seeks delay in Planned Parenthood v. Hazelrigg case

Attorney General Kris Mayes has taken action in the case of Planned Parenthood v. Hazelrigg by filing a motion with the Arizona Supreme Court. The motion requests a 90-day stay on the issuance of the mandate, allowing time for consideration on whether to seek a review from the United States Supreme Court regarding a recent decision by the state Supreme Court.

Attorney General Mayes stated, "The Arizona Supreme Court’s decision in the 1864 case relied on a statute that a federal court has enjoined as unconstitutionally vague." She emphasized that this situation raises significant federal questions related to the Due Process and Supremacy Clauses, necessitating thorough evaluation before deciding on further legal actions.

The state Supreme Court previously denied Attorney General Mayes' motion for reconsideration on April 26, 2024. The request for a stay is considered timely, as such requests are commonly granted by the court. Should Attorney General Mayes decide against pursuing a review at the United States Supreme Court, her office will inform the Arizona Supreme Court accordingly.
