Attorney General Todd Rokita has reached a settlement with the owners of Willow Brook Gardens Apartments, Wellington Apartments, and Briergate Apartments in Indianapolis. This action follows reports of inadequate treatment of tenants at these complexes.
Rokita's team addressed the issue promptly to enhance tenant rights and living conditions. "Our mission is to protect the rights of all people involved in the housing market, including tenants, homeowners, and aspiring homeowners, by investigating deceptive acts involving mortgage lending violations," said Attorney General Rokita. "We strive to ensure equal access to housing opportunities for regular, everyday Hoosiers. I'm very proud of my team for the good results they continue to achieve."
The settlement includes several key provisions:
- A payment of $70,000 in rent credits will be distributed to current tenant accounts based on health department notices, rental account discrepancies, consumer complaints, and related maintenance requests. Eligible tenants at Willow Brook, Wellington, and Briergate will receive notifications by mail regarding their eligibility. A total of 101 eligible tenant accounts will receive automatic credits ranging from $250 to $2,000 within thirty days.
- An additional $20,000 in restitution for complainants will be allocated by the Attorney General’s Office after reviewing consumer complaints and alleged harm. Eligible complainants will be notified directly by mail.
- Over 150 prior eviction proceedings conducted in Warren and Washington Township Small Claims Courts will be dismissed and expunged. Prior tenants do not need to take any action for this relief.
- A two-year compliance monitoring period will involve ongoing reports related to maintenance and open health department cases.
