States file lawsuit against EPA's 'Clean Power Plan 2.0

Attorney General Todd Rokita is co-leading a lawsuit involving 25 states to challenge a new rule from the U.S. Environmental Protection Agency (EPA). The rule in question is part of what has been termed the "Clean Power Plan 2.0," and according to Rokita, it poses a threat to the reliability of the power grid and could increase utility costs for residents.

Rokita criticized the EPA's new regulation, describing it as an overreach by the federal government that imposes unrealistic demands on power plants. He stated, "Hardworking Hoosiers and businesses depend on reliable energy at affordable prices. They understand these draconian measures are chasing unrealistic goals and will do nothing to actually improve our already good air quality."

The rule requires coal-fired plants to capture 90% of carbon emissions using technology that Rokita claims is expensive and unproven. He argues that this exceeds the EPA’s statutory authority and fails to adequately consider factors such as cost and grid reliability.

West Virginia Attorney General Patrick Morrisey joins Rokita in leading this legal action against what they describe as an inefficient rule by the EPA.
