Attorney General Todd Rokita, alongside West Virginia Attorney General Patrick Morrisey, is leading a 27-state effort to support former President Donald Trump's appeal to the U.S. Supreme Court. The brief argues that Congress, not the courts, has the authority to determine eligibility for federal office under Section 3 of the Fourteenth Amendment.
"American voters choose the President, not a partisan court in Colorado," stated Attorney General Rokita. He emphasized that this situation aims to "confuse and disenfranchise millions of voters wanting to cast their ballots for former President Donald Trump."
The brief challenges a state court's decision labeling Trump as an insurrectionist. It warns of significant implications beyond Colorado and potential chaos ahead of elections. The document calls for immediate intervention by the U.S. Supreme Court.
Rokita further stressed, "Trust in the integrity of our elections is essential to a free republic." He warned against activist judges potentially undermining voter confidence nationwide.
To ensure fair elections, there must be clarity on Trump's eligibility under Section 3 of the Fourteenth Amendment.
The 27-state petition for writ of certiorari accompanies this release.
