Indiana attorney general sues landlord for alleged apartment maintenance failures

Attorney General Todd Rokita has initiated legal proceedings against RICH-MONS Group LLC, a corporate landlord, over allegations of neglect in maintaining an apartment complex located in Plymouth, Indiana. The lawsuit claims that the landlord violated Indiana’s Deceptive Consumer Sales Act by failing to properly upkeep The Pointe Apartments.

"Tenants who pay their rent deserve the protection of the law," Attorney General Rokita stated. "Our legislature has made it clear that a landlord must maintain major systems in a leased property. Demanding rent from tenants while they are exposed to water intrusion, toxic mold, and dangerous electrical wiring is simply wrong."

The lawsuit, filed by Rokita’s Consumer Protection Division through its Homeowner Protection Unit, follows an inspection by City of Plymouth Building Commissioner Dennis Manuwal, Jr., which reportedly led to approximately 20 residents being displaced and ordered to evacuate immediately due to unsafe conditions such as roof leaks and visible black mold. Additionally, an analysis by a registered electrician revealed issues like open junction boxes and live wires.

The legal action seeks a jury trial along with prosecution costs and other damages for violations of the Deceptive Consumer Sales Act.

The Homeowner Protection Unit aims to safeguard individuals in the housing market by addressing deceptive practices related to mortgage lending and state and federal law violations. It collaborates with law enforcement agencies to ensure justice for homeowners and tenants.
