Texas Attorney General Ken Paxton issued a statement following the arguments presented in the U.S. Court of Appeals for the Fifth Circuit regarding the Deferred Action for Childhood Arrivals (DACA) program. Paxton expressed confidence in Texas's position against DACA, which was previously deemed unlawfully created by the Obama Administration in 2022.
"Today, Texas argued our case against DACA in the U.S. Court of Appeals for the Fifth Circuit. We already prevailed in 2022 when the court agreed that DACA was created unlawfully by the Obama Administration," said Paxton. He noted that due to Texas's lawsuit, first-time DACA applications have been halted for several years.
The recent legal proceedings focus on the Biden-Harris Administration's attempt to formalize DACA through notice and comment rulemaking. According to Paxton, "The court was receptive to our arguments that DACA continues to violate the rule of law and the separation of powers requirement enshrined by the United States Constitution."
Paxton emphasized his commitment to challenging what he describes as "illegal workarounds" and aims for a permanent end to DACA. "I have fought every step of the way to uphold the Constitution against illegal workarounds and look forward to defeating DACA—in its entirety—permanently," he stated.
