Court issues permanent injunction against Miami-based Brito brothers

The U.S. District Court for the Southern District of Florida has issued a permanent injunction against Miami tax return preparers, George and Luis Brito, along with their businesses. This legal action prohibits George Brito from preparing federal income tax returns, participating in any tax preparation business, assisting others in preparing tax returns, or transferring customer lists to others. Similarly, Luis Brito is barred from preparing income tax returns for individuals. The brothers have consented to the entry of this injunction.

The complaint against the Britos alleged that they owned or controlled Brito and Brito Accounting USA Inc. It further claimed that they prepared tax returns for clients with false deductions and credits, including fabricated residential energy credits and inflated business expenses.

According to the injunction, George Brito is permanently barred from any involvement in federal tax return preparation. His office at 407 Lincoln Rd #9A, Miami Beach, FL 33139, has been closed.

Luis Brito must inform his customers about his permanent ban on preparing most types of tax returns. However, he is allowed to prepare specific business forms under certain conditions. These include allowing unscheduled IRS visits and completing 24 hours of tax preparation education by December 31.

Deputy Assistant Attorney General David A. Hubbert of the Justice Department’s Tax Division announced this decision.

Taxpayers are advised to be cautious when selecting a tax preparer. The IRS provides resources on its website for choosing a preparer and offers a free directory of federal tax preparers.
