Ukrainian nationals face charges over Florida labor-staffing company operations

Two Ukrainian nationals appeared in court following their extradition from Thailand to the United States. They face charges related to labor-staffing companies they operated in Florida.

The superseding indictment, returned by a federal grand jury in Miami, alleges that between August 2007 and July 2021, Oleg Oliynyk, Oleksandr Yurchyk, and others ran several labor-staffing companies in South Florida. These companies include Paradise Choice LLC, Paradise Choice Cleaning LLC, Tropical City Services LLC, and Tropical City Group LLC. The indictment claims these staffing firms employed non-resident aliens unauthorized to work in the U.S. Additionally, Oliynyk and Yurchyk are accused of conspiring to defraud the IRS by not withholding Social Security, Medicare, and income taxes from workers' paychecks and filing false corporate tax returns.

The defendants are charged with conspiracy to defraud the United States, conspiracy to harbor non-resident aliens and induce them to stay in the country, and conspiracy to commit money laundering. If convicted, each faces up to five years for defrauding the U.S., ten years for harboring aliens, and twenty years for money laundering. Sentences will be determined by a federal district court judge based on U.S. Sentencing Guidelines and other statutory factors.

Acting Deputy Assistant Attorney General Stuart M. Goldberg of the Justice Department’s Tax Division and U.S. Attorney Markenzy Lapointe for the Southern District of Florida announced the charges.

The Department of Homeland Security, Homeland Security Investigations, and IRS Criminal Investigation are handling the case investigation. The Justice Department’s Office of International Affairs assisted significantly in securing the arrests and extraditions of Oliynyk and Yurchyk. The United States expressed gratitude towards its Embassy in Thailand - Regional Security Office as well as Thai law enforcement partners including the Royal Thai Police and Office of the Attorney General.

Senior Litigation Counsel Sean Beaty along with Trial Attorneys Matthew C. Hicks and Wilson R. Stamm from the Tax Division are prosecuting this case alongside Senior Litigation Counsel Christopher J. Clark from the U.S. Attorney's Office for the Southern District of Florida.

An indictment is merely an allegation; all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
