Today, additional plaintiffs joined the lawsuit filed by America First Legal (AFL) against the Fairfax County School Board. The case was initially brought on behalf of a female student at Fairfax County Public Schools (FCPS) for permitting teenage boys to use female restrooms and for compelling students to accept critical gender theory, allegedly violating students' free speech and free exercise rights under the Virginia Constitution.
The Fairfax County School Board has repeatedly attempted to dismiss the case and prevent judicial review of its policies. AFL has consistently opposed these efforts, and today's development ensures that Fairfax will have to address its policies and alleged violations of students' constitutional rights.
Ian Prior, Senior Advisor at America First Legal, stated: "For years, parents have been fighting back against Fairfax County Public Schools' patently unconstitutional policies. Now, students are joining that fight to vindicate their rights, as are all other students who have been subjected to FCPS’s clear abuse of state power. We are proud to stand up for those students and ensure that FCPS is exercising its great responsibilities in accordance with Virginia constitutional and statutory law."
