Attorney General Mayes announces sentencing in organized retail theft case
PHOENIX – Attorney General Kris Mayes today announced the sentencing of Bay Horn. Horn, a resident of California, came to Arizona and committed an organized retail theft scheme that defrauded TJ Maxx of $26,000 over a one-month period in 2023. He and other individuals collected merchandise in stores including TJ Maxx and Home Goods, concealed the items in bags, walked past the point of purchase, and then returned the items to a cashier falsely requesting a refund.
“This case sends a strong message: organized retail theft will not be tolerated in Arizona,” said Attorney General Mayes. “Those who defraud businesses and drive up costs for consumers will face serious consequences in our state.”
On July 29, 2024, Horn pleaded guilty to Fraud Schemes & Artifices, a Class 2 felony, and Organized Retail Theft, a Class 4 felony. On August 27, 2024, Horn was sentenced to 2.25 years in the Arizona Department of Corrections and a consecutive sentence of 4 years on probation. Horn was ordered to pay restitution in the amount of $11,016.00 to TJ Maxx for his involvement.
