LOS ANGELES (Legal Newsline) - A customer unhappy with the gluten-free bagels at Trader Joe's has filed a class action lawsuit.
A lawsuit was filed June 28 in Los Angeles federal court against Trader Joe’s Company alleging it falsely advertised its "Gluten Free" Almost Everything Bagels, which were found to contain high levels of gluten.
Independent testing by Moms Across America revealed that the product contained 269.8 ppm of gluten, significantly exceeding governmental and certification limits, the suit says.
That testing was released June 10 and performed by the Health Research Institute.
"Plaintiff would not have purchased the product had she known the product contained gluten," the suit says. "As a result, Plaintiff suffered injury in fact when she spent money to purchase the product she would not have purchased absent Defendant's misconduct."
The lawsuit claims that Trader Joe’s engaged in deceptive advertising and seeks redress under California's Consumers Legal Remedies Act (CLRA) and Unfair Competition Law (UCL). The plaintiff is seeking damages, restitution, and injunctive relief to prevent further misleading labeling practices by Trader Joe’s.
