Company sues law firm after it files 36 arbitration claims

SAN DIEGO (Legal Newsline) - An Oregon multimedia company has gone to court to stop a law firm from filing arbitration claims against it in California.

Designtechnica Corporation (DTC) filed a lawsuit June 18 in the United States District Court for the Southern District of California against Swigart Law Group (SLG) and 36 of its clients. 

DTC seeks declaratory and injunctive relief to prevent SLG from filing arbitration claims under California law, arguing that its website's Terms of Use mandate arbitration under Oregon law. 

The complaint alleges that SLG's clients have filed identical claims accusing DTC of violating the California Invasion of Privacy Act by intercepting electronic communications on its websites. DTC contends these claims are baseless and an attempt to pressure settlements through arbitration fees.
