ATLANTA (Legal Newsline) - A wrongful death lawsuit says the last officer on the scene of a police chase shot the subject eight times while the man was pinned in his car.
In a lawsuit filed in Atlanta federal court on June 24, Brandi Carr, acting as the Temporary Administrator of the Estate of Devonte Dawayne Brown and in her individual capacity, has brought charges against Officer Ian McConnell.
The complaint stems from an incident on August 18, 2021, when McConnell allegedly used excessive and deadly force resulting in the death of Devonte Brown, a 28-year-old unarmed Black male.
The incident began with a traffic stop by Officer Mark Walker that escalated into a chase involving multiple officers. The suit says McConnell's car struck Brown's on the driver's side, trapping Brown.
McConnell ultimately fired 12 shots at Brown's vehicle after it was immobilized, killing him, the suit says. The plaintiff argues that Brown posed no immediate threat to law enforcement or others at the time he was shot.
McConnell faced no criminal charges after a grand jury considered them, while the family is accusing the district attorney of botching the case.
Carr seeks compensatory damages exceeding $100,000, punitive damages, legal costs, and other relief deemed appropriate by the court. She is represented by attorneys Crystal R. Carey, Chantel Cherry-Lassiter, Bernarda Villalona (pending special admission), and Harry M. Daniels from the Law Offices of Harry M. Daniels.
