TRENTON, N.J. (Legal Newsline) - The clothing retailer Burlington Coat Factory takes your information when you open its emails, a New Jersey class action lawsuit says.
Plaintiff Jessica Segovia filed a class action lawsuit June 6 in New Jersey federal court against Burlington Coat Factory Warehouse Corporation.
The complaint alleges Burlington embedded hidden spy pixel trackers within its promotional emails sent to Arizona residents without their consent. These trackers collected sensitive information such as the time and place emails were opened, the duration of reading, location data, IP addresses, device information, and email forwarding details, the suit claims.
This practice allegedly violates Arizona's Telephone, Utility and Communication Service Records Act (A.R.S. § 44-1376), which prohibits procuring communication service records without authorization.
The lawsuit claims that Burlington's actions constitute an invasion of privacy and seeks actual damages or statutory damages of $1,000 per violation, along with profits made from these violations. The plaintiff also demands injunctive relief to prevent further unauthorized tracking and collection of email recipients' data.
