Lawyer hoarding settlement fees for himself, lawsuit says

WEST PALM BEACH, Fla. (Legal Newsline) - A Florida lawyer won't pay his clients' outstanding medical bills and conceals their settlements, a health care provider is alleging.

Daniel Charleston and Advanced Medical Diamond Group LLC filed a lawsuit May 4 in Palm Beach County Circuit Court against attorney Mark Januschewski, alleging that he failed to honor medical liens for services provided to personal injury clients. 

The plaintiffs claim that despite multiple attempts to resolve the issue, Januschewski did not pay the outstanding balances totaling $166,271.62 for 31 patients treated between 2015 and 2021. The lawsuit seeks damages and a jury trial.

The suit claims Januschewski instructed clients not to tell AMDG that their claims had been settled, thereby hindering AMDG's chances to get repaid for services rendered.

Charleston is representing himself.
