FORT SMITH, Ark. (Legal Newsline) - An Arkansas lawsuit says a Raisin Bran fan chomped on a black magnet virtually identical to a raisin.

A lawsuit was filed April 29 in Sebastian County Circuit Court by Robert T. Cates against several entities including Kellogg Company, Kellanova, and Walmart Inc.

The plaintiff alleges that he suffered injuries after consuming a box of Kellogg’s Raisin Bran cereal purchased from a Walmart store in Fort Smith.

According to the complaint, Cates broke multiple teeth upon biting into magnets that were allegedly present in the cereal. They were basically the same color and shape of the raisins in the cereal, he says.

The lawsuit claims negligence and breach of warranties on the part of the defendants for allowing non-consumable items to be included in the product. The plaintiff seeks damages for permanent injury, medical expenses, and loss of quality of life.

Sam Sexton III of Sexton & Masri represents the plaintiff.
