Lawsuit: Tire clobbers woman on go-kart track

FAYETTEVILLE, Ark. (Legal Newsline) - An Arkansas amusement park faces litigation after a woman says a go-kart wreck caused a tire on the barrier to come free and strike her in the head.

Tasha Josenberger filed a lawsuit May 10 in Washington County Circuit Court against Hillbilly Holler Corporation, doing business as Lokomotion Family Fun Park, alleging negligence leading to personal injury. 

Josenberger claims that she suffered serious injuries at the amusement park located in Fayetteville. According to the complaint, on May 1, 2022, she was a passenger in a go-kart driven by her cousin at Lokomotion's facility.

The go-kart was struck from behind by another go-kart and hit the outside barricade of the track, the suit says. A tire used as a barrier broke free and hit Josenberger in the head, the suit says.

The plaintiff alleges that Lokomotion failed to maintain its premises safely and specifically points out issues with the go-kart track. She accuses it of failing to properly affix the barrier tire to the wall of the track and not using appropriate materials for constructing the track barrier. 

She also claims it did not regularly inspect for hazards or defects and failed to repair known defects.

As a result of these alleged failures, Josenberger claims she sustained damages including past and future medical bills, pain and suffering, permanent neurological impairment, visual impairment, aggravation of pre-existing conditions and loss of enjoyment of life.
