Wrongful death lawsuit: Fisherman's line tangled with power line, electrocuting him

ORLANDO, Fla. (Legal Newsline) - The estate of a Florida fisherman killed when his line crossed with a power line is suing Duke Energy.

John Charles Keller and Ascension Kelly, parents of the late Tyler Adam Keller, filed a lawsuit May 7 in Orange County Circuit Court against Duke Energy Corporation. 

The plaintiffs allege that their son was electrocuted and killed while fishing in ponds on Bachman Road near power lines owned and maintained by Duke Energy. The incident occurred on November 25, 2023, at a property in Orlando.

According to the complaint, a portion of the power lines had been damaged prior to the incident, posing an unreasonable risk of electrocution. 

It claims the power lines were dangerously low, too. 

"Duke Energy had a duty to act reasonably and with due regard for the safety and welfare of the general public, including Mr. Keller, to operate its business in a safe and reasonably product manner so as not to cause harm or death to the general public or Mr. Keller," the suit says.

Todd Falzone of Kelley Uustal represents the plaintiff.
