CLEVELAND (Legal Newsline) - Following a split, a law firm representing clients troubled by debt has gone to court to retrieve their information from a settlement company.
A legal dispute has arisen between Castro Law, LLC and JGW Debt Settlement that led to a lawsuit was filed on May 1 in the Court of Common Pleas in Cuyahoga County, Ohio. The case has since been removed to federal court.
The lawsuit revolves around a written agreement between the two parties wherein JGW provided outsourced customer service and administrative support to Castro Law and its clients.
In March 2024, JGW abruptly announced it was terminating the agreement and severing ties with Castro Law, the suit says.
This move is considered baseless by Castro Law and is seen as a repudiation of the agreement. The agreement contains a mandatory mediation and arbitration provision, which Castro Law has invoked concurrently with filing this complaint, the suit says.
However, despite repeated demands from Castro Law, JGW has refused to return all of Castro's client data as required by the agreement, the suit claims. This has led to an urgent need for judicial intervention as Castro claims that without access to this information, it cannot effectively provide legal services to their clients, the suit says.
Castro is seeking injunctive relief for the return of its client information during the pendency of mandatory mediation and arbitration proceedings.
