HOUSTON (Legal Newsline) - A Texas lawyer says a company that was supposed to put his ad on cars and drive them around failed to deliver.

Brian White & Associates filed a lawsuit April 10 in Harris County District Court against Carvertise, Inc., a Delaware-based company that removed the case to Houston federal court on May 5.

The plaintiff alleges that Carvertise failed to meet its contractual obligations related to advertising on commercial rideshare vehicles.

According to the court filing, the two parties entered into an agreement on July 7, 2023, followed by a second contract on November 19, 2023. Under these contracts, Carvertise was supposed to use a certain number of rideshare vehicles for advertising related to ABW's business and ensure specific standards regarding miles driven and geographic area utilized.

The plaintiff claims that Carvertise did not provide proof of installation or data about miles driven as requested in November 2023. Moreover, after two accidents involving Carvertise's vehicles occurred in October 2023 and January 2024, the defendant allegedly failed to provide information about the incidents or proof of car replacements.

Despite these alleged breaches of contract by Carvertise, ABW says it paid over $264,000 in compliance with its initial contractual requirements. The plaintiff is seeking monetary relief between $250,000 and $1 million excluding net interest or exemplary damages and penalties, attorney fees, and court costs.
