Red Lobster accused of shorting people who buy biscuit mix

EAST ST. LOUIS, Ill. (Legal Newsline) - Red Lobster lies when it claims its biscuit mix makes 10 servings, a class action lawsuit alleges.

In a lawsuit filed in March in Illinois' St. Clair County Circuit Court, plaintiff Cassandra Neubauer has accused Red Lobster Hospitality LLC and Continental Mills, Inc. of misrepresentation and deceptive business practices. 

The case revolves around the companies' Cheddar Bay Biscuit Mix product, which is claimed to make 10 biscuits per box.

Neubauer alleges that this claim is false, as the actual weight of the mix provided in each box only amounts to approximately seven biscuits. This discrepancy allegedly results in consumers receiving 31.38% fewer servings than promised on the packaging.

The plaintiff seeks to recover 31.38% of all retail sales of the product in damages or $0.92 for every box sold due to breach of express and implied warranties, false advertising, and unjust enrichment under the Illinois Consumer Fraud and Deceptive Business Practices Act (ICFA). In addition to monetary compensation, Neubauer also seeks injunctive relief.

The defendants have removed the case to Illinois federal court. David Nelson of Nelson & Nelson in Belleville is representing the plaintiff, along with other attorneys.
