Federal Agencies Launch Portal for Public Reporting of Anticompetitive Practices in Health Care Sector

The Justice Department, Federal Trade Commission (FTC) and the Department of Health and Human Services (HHS) have unveiled an online portal named HealthyCompetition.gov for the public to report potential anticompetitive practices in the health care sector. The initiative aims to address concerns regarding unfair competition and monopolistic practices that could impact healthcare affordability and quality in the United States.

Assistant Attorney General Jonathan Kanter emphasized the importance of competition in healthcare, stating, "Competition in health care is crucial to ensuring fair and competitive wages across the healthcare sector and affordable and quality healthcare for all Americans." The launch of HealthyCompetition.gov is part of the Biden-Harris Administration's efforts to promote competitive health care markets that benefit patients, providers, payers, and workers.

FTC Chair Lina M. Khan highlighted the need to address unfair competition practices, stating, “All too often, we hear how unfair methods of competition and monopolistic practices may be depriving Americans of access to affordable, high-quality healthcare.” The collaboration between the FTC, DOJ, and HHS through this portal will provide a platform for the public to report anticompetitive behaviors that harm consumers and workers.

HHS Secretary Xavier Becerra underlined the significance of competitive health care markets in providing quality choices and lowering costs for coverage. Becerra stated, “Americans depend on competitive health care markets to provide quality choices and lower costs for coverage. That’s why we are working to tackle anticompetitive practices in the health care markets.” The public's input through HealthyCompetition.gov will help identify and address monopolistic practices that hinder healthcare delivery in the country.

Complaints submitted through the portal will be reviewed by staff at the Justice Department’s Antitrust Division and FTC. If a complaint raises concerns under antitrust laws or falls within HHS authorities, it will undergo further investigation. The privacy and confidentiality policies governing information submitted through the portal are available on the DOJ and FTC websites.

HealthyCompetition.gov represents a collaborative effort by federal agencies to promote competition in health care markets and ensure access to high-quality, affordable care for all Americans. This initiative builds on previous joint efforts by the Justice Department, FTC, and HHS to address anticompetitive practices in the healthcare sector.
