Delayed surgery leads to wrongful death lawsuit against the federal government

EL PASO, Texas (Legal Newsline) - The family of a man who died after surgery was delayed at the William Beaumont Army Medical Center has filed a wrongful death lawsuit against the government.

Rosalva Correa, mother of the late Adrian Correa, filed a lawsuit March 11 against the United States of America in U.S. District Court for the Western District Court of Texas. 

The lawsuit accuses the U.S. Department of Army's William Beaumont Army Medical Center (WBAMC) and its outpatient clinic, Troop Medical Clinic in El Paso, Texas, of medical negligence that led to her son's death.

Adrian Correa was diagnosed with gastric adenocarcinoma in June 2022 and underwent treatment at WBAMC. However, Rosalva alleges that there was a negligent delay in performing surgery, which was Adrian's only treatment option. 

After not receiving adequate care at WBAMC, Adrian sought help from M.D. Anderson Cancer Center in Houston but unfortunately passed away due to complications from his condition, the suit says.

The lawsuit lists several instances of negligence including failure to perform necessary tests and scans, misdiagnosis, delayed treatment plan reassessment, and failure to remove a tumor from Adrian's stomach in a timely manner.

Rosalva is seeking $2.5 million in damages for loss of companionship, mental anguish, loss of inheritance as well as funeral and medical expenses incurred prior to Adrian's death.

She is represented by Walter Boyaki of Boyaki Law Firm. Judge David Guaderrama has been assigned the case.
