ORLANDO, Fla. (Legal Newsline) - A Florida woman says her son was burned when the battery pack in his Miles Morales Halloween costume overheated.

Spencer Spirit Holdings, Inc. and Spirit Halloween Superstores, LLC are facing a lawsuit filed by Quiana Kellum on behalf of her minor son, Eric Acquah. The suit was filed Feb. 27 in Orange County Circuit Court.

Kellum alleges that a Miles Morales Halloween costume purchased from the defendants caused significant burns to her son due to a malfunctioning or overheating battery pack. The plaintiff asserts that the costume had not been misused or modified post-sale before it failed.

The complaint claims that both Spencer Spirit Holdings and Spirit Halloween Superstores were involved in designing, manufacturing, distributing, selling, and marketing the costume. Furthermore, it is alleged that they tested and inspected the costume to ensure it was free from defects and safe for consumer use.

The plaintiff seeks damages in excess of $50,000 for injuries including severe burns to the body, pain and suffering, disability, mental anguish, embarrassment and humiliation, loss of capacity for enjoyment of life as well as medical and nursing care costs.
