Attorney General Morrisey Issues Statement Following U.S. Supreme Court Reversal of Colo. Supreme Court's Ballot Disqualification of Trump

West Virginia Attorney General Patrick Morrisey issued the following statement after the U.S. Supreme Court on Monday reversed a decision from Colorado that kept former President Donald Trump off the ballot for that state’s Presidential Primary Elections.

Attorney General Morrisey co-led an amicus brief with Indiana urging the U.S. Supreme Court to reverse the Colorado Supreme Court’s decision, arguing that Congress must decide whether to disqualify a candidate under Section 3 of the Fourteenth Amendment.

“This ruling is truly the right decision,” Attorney General Morrisey said.

“Lawsuits like this one undermine citizens’ right to choose who they want to represent them in every level of government and impede a fair and free election process,” Attorney General Morrisey added. “Had the Supreme Court ruled differently, chaos would have dominated the upcoming presidential election.  I’m happy they agreed with us that that outcome was unacceptable.”

As a result of the Supreme Court’s decision, individual states will not have the authority to deny a candidate for federal office from the ballot—this resolves the issue nationwide.
