LOS ANGELES (Legal Newsline) - The actor who portrayed Wolfman in the first Top Gun movie is suing Paramount Pictures over using his likeness in the blockbuster sequel.
Actor Barry Tubb sued Paramount on Feb. 21 in U.S. District Court for the Central District of California. Tubb alleges Paramount used his image without permission or compensation in key scenes of the sequel, Top Gun: Maverick, which was released in May 2022.
Tubb's legal representation includes Joseph N. Casas and Dennis Postiglione from The Casas Law Firm, P.C. According to Tubb's claim, he had only authorized limited use of his image for purposes related to the original Top Gun movie and not its sequel.
He further states that Paramount knowingly featured his image in key scenes of the sequel without seeking his permission or offering compensation.
The lawsuit seeks damages and injunctive relief relating to Paramount’s alleged misappropriation and unauthorized publication of Tubb's image and likeness. The actor accuses Paramount of violating section 43 of the Lanham Act, infringing on his right to privacy and publicity, as well as committing various common law torts.
