Fla. woman sues her personal injury lawyer, alleges he botched her case

TAMPA, Fla. (Legal Newsline) - An unhappy client is suing a Florida personal injury law firm, alleging it ruined her car accident case.

Mary Kreitner filed a lawsuit Jan. 12 against The Malki Law Offices, P.A., also known as Malki Law Firm, and Afram Malki. The case was filed in Hillsborough County Circuit Court.

The complaint arises from an incident on November 10, 2019, when Kreitner was hit by a Department of Homeland Security truck. She sustained severe injuries leading to pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, hospitalization expenses, medical and nursing care costs, loss of earnings and aggravation of a previously existing condition, the suit says.

Kreitner hired the defendants to provide legal services related to her accident and injuries. On March 9, 2022, they filed a complaint on her behalf against the United States of America in federal court, but Kreitner alleges that the defendants failed to meet required deadlines for disclosing expert witness reports and completing discovery in her lawsuit.

The court granted a motion for summary judgment on September 1, 2023, due to the defendants' failure to disclose an expert opinion on causation. As a result of their actions or inactions, Kreitner claims she has suffered significant damages including the value of the lawsuit, pre-judgment interest and costs.
