Lobster restaurant faces lawsuit after customer bites shell

TAMPA, Fla. (Legal Newsline) - A Florida lawsuit alleges injuries from biting down on a shell at a lobster restaurant.

Todd Cook filed a lawsuit Jan. 4 against Mikerry LLC, doing business as Lucky Lobster Co., in Hillsborough County Circuit Court. The suit alleges that Cook suffered bodily injury and other damages after biting into food that contained shell and other hard objects at the restaurant on September 25, 2023. 

Cook says cracked, fractured and/or lost teeth as a result of biting down on the shell and that Lucky Lobster was negligent in not warning him of potential dangers in his food.

"Lucky Lobster Co. knew or should have known of the unsafe and/or hazardous material within said food," the suit says.

The plaintiff is seeking damages in excess of $50,000 for pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, hospitalization expenses, medical and nursing care costs, and loss of earnings.
