NEW YORK (Legal Newsline) - New York's Museum of Sex faces a class action lawsuit accusing it of unfairly charging a $4 fee to customers purchasing tickets online.
Arling Ruiz filed a class action lawsuit Jan. 9 against The Museum of Sex LLC, accusing the company of violating New York Arts and Cultural Affairs Law § 25.07(4). The suit was filed in U.S. District Court for the Southern District of New York.
According to the complaint, the museum's website misleads customers by quoting a fee-less price for admission tickets, only to add a $4 service charge at checkout under the ambiguous category "taxes & fees."
This charge is only revealed after a ticket is selected and if the customer clicks on the question mark icon next to "taxes & fees." Furthermore, customers are given a four-minute countdown to complete their purchase.
The plaintiff alleges that this tactic has allowed the defendant to swindle substantial sums from its customers. The lawsuit seeks actual and/or statutory damages, reasonable attorneys' costs and fees, and injunctive relief.
