Wrongful death lawsuit blames Mass. hospital for fall

BOSTON (Legal Newsline) - The estate of a man who fell and died at a Massachusetts hospital has filed a wrongful death lawsuit.

A lawsuit was filed Jan. 5 against Steward Carney Hospital, Inc., and two unnamed defendants (John and Jane Doe) by Timothy E. Tracey, the personal representative of the estate of Robert E. Tracey. The case was filed in the Superior Court of Suffolk County on Jan. 5.

The complaint alleges that 94-year-old Robert Tracey was admitted to Steward Carney Hospital in Dorchester on January 3, 2021, due to dizziness and not feeling well. The following day, due to alleged poor communication between departments and lack of supervision, Mr. Tracey fell and sustained multiple fractures without any fall precautions in place. 

He died 25 days later from complications related to his injuries.

The plaintiff accuses the defendants of carelessness, recklessness, and gross negligence. The lawsuit seeks compensation for personal injuries, medical bills, pain and suffering, loss of dignity, mental anguish as well as serious physical and emotional harm suffered by Tracey.
