TAMPA, Fla. (Legal Newsline) - A customer at a Florida shooting range says in a lawsuit that he was shot in the arm by a ricochet.
A lawsuit was filed Dec. 15 against Fishhawk Sporting Clays Corporation by David Villarreal in Hillsborough County Circuit Court. The complaint is for a Pure Bill of Discovery, seeking to obtain limited production of documents from Fishhawk.
Specifically, Villarreal seeks to identify Fishhawk's insurance carrier and retrieve required information.
The lawsuit stems from an alleged incident that occurred on August 20, 2023, when Villarreal was struck by a ricocheting bullet while at Fishhawk's outdoor shooting facility. The bullet fragments penetrated deeply into his right arm muscle, causing him extensive pain and discomfort and necessitating surgery to remove the fragments, the suit says.
Despite sending two Letters of Representation to Fishhawk on October 13 and November 17, 2023, requesting information about their insurance policy as per Florida Statute 627.4137, Villarreal claims that Fishhawk has yet to respond.
Villarreal now seeks an order from the court requiring Fishhawk to provide the requested information. Patricia Francois and other lawyers at Demesmin & Dover represent him.
