PHILADELPHIA (Legal Newsline) - Comcast customers claim their personally identifiable information wasn't protected from a December data breach
Comcast Corporation, a leading provider of broadband and other services to residential customers in the United States, is facing a class action lawsuit for alleged violation of California's Unfair Competition Law and other consumer protection laws. The lawsuit, filed Dec. 19 in Philadelphia federal court, also accuses Comcast of deceit by concealment, negligence, intentional misrepresentation, breach of express warranty and breach of implied warranty.
The plaintiff in the case is Steven Prescott, alleges that Comcast failed to safeguard the sensitive personal identifying information of millions of its consumers or implement robust security measures to prevent this information from being stolen. This is despite Comcast's representations about its strong security practices which include technical, administrative, and physical safeguards, the suit says.
Prescott had his personal identifiable information compromised in a data breach announced by Comcast on December 19, he says. He had purchased Xfinity high-speed internet around 2015 and was required to create an Xfinity account in which he provided his name, postal address, email address and date of birth, among other details.
Prescott's lawyer is Kenneth Jay Grunfeld of Kopelowitz Ostrow, plus lawyers from Clarkson Law Firm and Tycko & Zavareei.
