Attorney General Jason Miyares of Virginia has issued an official Attorney General's Opinion, in response to a request from Delegate A.C. Cordoza, regarding proton radiation therapy and health insurance coverage. The opinion clarifies that Virginia law does not allow insurance carriers to deny coverage for proton radiation therapy based on a higher standard of clinical evidence than what is used for other forms of cancer radiation therapy.

Proton radiation therapy is an advanced radiation technology that precisely treats tumors with minimal side effects while protecting nearby healthy tissue. It is a different form of radiation than x-rays, with different effects on the human body. However, prior authorizations and insurance denials have been significant barriers to this life-saving treatment.

The Hampton University Proton Therapy Institute, the largest standalone proton treatment center in the United States, has successfully treated over 4,000 patients battling cancer since its establishment in 2010. It was created in response to the high mortality rate of prostate and breast cancer in the Hampton Roads area. Additionally, the Inova Department of Advanced Radiation Oncology and Proton Therapy in Fairfax County is the second proton therapy facility in Virginia.

Attorney General Miyares emphasized the importance of streamlining the prior authorization process and expanding patient access to proton radiation therapy. He stated, "It's essential that every patient can get the treatment that is right for them." Delegate A.C. Cordoza expressed gratitude for the Attorney General's opinion, stating that it will increase access to life-saving proton therapy and improve the quality of life for cancer patients in Hampton Roads.

Hampton University President Darrell K. Williams praised the opinion for promoting inclusivity and cancer health equity. He highlighted the transformative potential of proton therapy and the importance of making it accessible to all who could benefit from it.
