ORLANDO, Fla. (Legal Newsline) — The families of those buried at a Florida cemetery are suing a developer they say desecrated the bodies there.
Alison Robinson and many others filed a complaint Nov. 10 in Orange County Circuit Court against Pulte Home Company LLC and S&ME Inc., alleging tortious interference with and mishandling of remains and other claims.
According to the plaintiffs' complaint, Pulte is the developer of a new subdivision, Longleaf at Oakland, with S&ME as the designer. They claim Pulte's new subdivision is next to the historic Oakland Tildenville Cemetery and that a drive constructed in the area was made on top of and filled in a low-lying area that provided drainage for rain.
They allege that the new road built by Pulte has caused rainwater to flood the cemetery and that the defendants knew the piped storm water would be pumped into the cemetery, which resulted in a "deluge of water" on the graves and remains at Oakland Tildenville. The plaintiffs further allege the defendants have failed to stop the floodwaters which have caused desecration and have publicly denied any responsibility.
The plaintiffs seek monetary relief of more than $50,000, interest and all other just relief. They are represented by Tyler Kobylinski of Morgan & Morgan PA in Orlando.
