WEST PALM BEACH, Fla. (Legal Newsline) – A Florida lawsuit says the owner of a shopping and luxury hotel area is to blame for the death of one of its visitors.
Amy Davenport, individually and as parent and natural guardian of B.D., J.D., and M.D., minors, filed a complaint Nov. 13 in Palm Beach County Circuit Court against Harbourside Place LLC, Management Associates and the Town of Jupiter.
According to the plaintiffs' complaint, Amy Davenport's husband, Nathaniel Davenport, was at Harbourside Place in Jupiter on Oct. 22, 2023, with their minor children. They allege that while in the area of the Harbourside amphitheater near an open fountain, Davenport suffered electrical shock and died from electrocution.
The plaintiffs claim that an investigation revealed that some of the light fixtures in the fountain were leaking electrical voltage. They further claim the Town of Jupiter has requested repair or demolition of the fountains, which would "impair and prejudice" their personal injury and wrongful death claims.
The plaintiffs are seeking to have the court instruct Harbourside to preserve the fountain, its light fixtures and overall electrical system.
