Lawsuit says energy drinks have preservatives, despite advertising

SAN FRANCISCO (Legal Newsline) — The maker of Rowdy energy drinks faces a class action lawsuit alleging it wrongly promotes its products as preservative-free.

Gerald P. Lake, individually and on behalf of all others similarly situated, filed a complaint Nov. 27 in the U.S. District Court For The Northern District Of California against Rowdy Beverage Inc., alleging violation of the Consumers Legal Remedies Act and other claims.

Lake alleges in his class action that he purchased Rowdy's Pink Lemonade Sugar Free energy drink and that the drinks are fraudulently and misleadingly labeled as containing "No Preservatives." 

He claims that the product contains citric acid and/or ascorbic acid, which are synthetic and artificial preservatives. Lake alleges that the defendant deceived consumers into believing the drink was preservative free and that they would not have purchased the product had they known the products actually do contain preservatives. 

He further alleges the defendant engaged in a scheme through its packaging, labeling and advertising by omitting the true contents of the drink. 

Lake and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Ben Pierce of The Pierce Gore Law Firm PC in San Francisco.
