Tired of going to gym, plaintiffs file lawsuit

LOS ANGELES (Legal Newsline) — Customers of LA Fitness are suing the company, claiming they were unable to cancel their memberships.

Leonna Brown, Katherine Burnett, Chris Golden and others filed a complaint Nov. 9 in the U.S. District Court for the Central District of California against Fitness and City Sports Club, alleging violations of California Unfair Competition Law, breach of contract and other claims. 

The plaintiffs, according to their class action, acquired gym memberships to LA Fitness, Esporta Fitness or City Sports Club, which are all managed by the defendant. 

They claim that the defendants violated their membership agreements by failing to abide by cancellation policies in their contracts. The plaintiffs further claim that they were falsely told that if they chose to cancel their membership, they would be able to cancel at anytime by just verbally notifying the gym.

They allege that despite even after sending written notice to the defendant's corporate office to cancel memberships, their debit and credit cards are still being charged for membership fees. They also allege after confirming their cancellations, they were still being billed for months. 

The plaintiffs seek monetary relief, interest, trial by jury and all other just relief. They are represented by Jill Parker of Parker & Minne LLP in Los Angeles; Danielle Perry of Mason LLP in Washington, D.C.; and D. Aaron Rihn and Sara Watkins of Robert Peirce & Associates PC in Pittsburgh.
