AKRON, Ohio (Legal Newsline) — Gamestop faces a class action lawsuit that says it adds a shipping and handling charge, even when customers qualify for free shipping.
Ryan Page, on behalf of himself and all others similarly situated, filed a complaint Oct. 9 in the U.S. District Court for the Northern District of Ohio against Gamestop Corporation, alleging violation of state consumer protection laws and other claims.
Page alleges in his class action that Gamestop "lures consumers into providing their credit card information" and then falsely represents that they will qualify for free shipping. He claims Gamestop exploits customers by charging them for shipping and handling even after they meet Gamestop's advertised minimum spending requirements for free shipping.
Page alleges that Gamestop markets free shipping but then adds a line item charge to deceive customers into making product purchases. He further alleges Gamestop then attempts to cover up the charge and deceives customers by claiming they were only charged for "handling" and not "shipping."
Page and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Andrew Shamsi of Shamis and Gentile PA in Miami; Sophia Goren Gold of Kalielgold PLLC in Berkeley, California; and Jeff Kaliel and Amanda Rosenberg of Kalielgold PLLC in Washington, D.C.
