NEW YORK (Legal Newsline) — Nestle Purina Petcare Company is facing a class action alleging it uses synthetic ingredients in pet food it markets as "natural."
Adrienne Pietres and Brenda Natoli, individually and on behalf of all others similarly situated, filed a complaint Oct. 12 in the U.S. District Court for the Southern District of New York against Nestle Purina Petcare Company, alleging violation breach of express warranty, violation of New York General Business law and other claims.
The plaintiffs claim in their class action that Nestle misleadingly labels its multiple types of wet and dry pet food as "natural" so that health-conscious pet owners purchase a food that does not contain synthetic ingredients. They allege Nestle makes false representations about pet food because it contains multiple synthetic ingredients including copper sulfate, pyridoxine hydrochloride and menadione sodium bisulfite complex.
The plaintiffs further allege that consumers would not have purchased the product or not have paid as much had they known the truth.
The plaintiffs and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Joshua Arisohn and Julian Diamond of Bursor & Fisher PA in New York City.
