Kohl's faces class action alleging sale prices aren't as discounted as they seem

MADISON, Wis. (Legal Newsline)  — A proposed class action lawsuit says Kohl's is tricking customers with its price comparisons.

Michelle Cortez Gomez filed a complaint Oct. 2 in the U.S. District Court for the Western District of Wisconsin against Kohl's Corporation and Kohl's Inc., alleging unjust enrichment and other claims. 

Gomez alleges in her class action that she purchased numerous items from the Kohl's website. She alleges that Kohl's is violating Wisconsin law by falsely and misleadingly using price comparison, offers and discounts regarding its merchandise. 

Gomez claims Kohl's falsely represents consumers can purchase items at substantial discount from the "regular" or "original" prices when those prices are arbitrary and inflated. She alleges Kohl's actions falsely lead consumers to believe they are purchasing products that have a high value, which creates a higher demand for the products. 

Gomez further alleges the "price-comparison scheme" causes consumers to spend money they could not otherwise spend. She also claims Kohl's promotions and discount coupons cause consumers to actually pay more than what most consumers pay for the same item because of high markups. 

Gomez and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Martin Woodward of Kitner Woodward PLLC in Dallasnand others.
