ORLANDO, Fla. (Legal Newsline) — CVS and the owner of an Orlando store are blamed for the murder of a man in its parking lot.
Stephanie Thompson, as personal representative of the Estate of Uken Cummings, deceased, filed a complaint Sept. 12 in Orange County Circuit Court against Shamosh 5 LLC, CVS Health Corporation, CVS Pharmacy Inc., and Holiday CVS LLC alleging negligence and wrongful death.
According to Thompson's complaint, her father Uken Cummings was at a CVS store in Orlando on Jan. 30, 2022. She claims that while in the CVS parking lot, her father was assaulted, carjacked and shot multiple times, which resulted in his death.
Thompson alleges the defendants failed to reasonable protect invitees on their premises and failed to take security measures to control and guard against criminal activity. She further alleges there were numerous criminal acts including muggings, shootings, robberies and drug dealing in and around the premises.
Thompson claims the defendants also failed to warn of the dangerous conditions and failed to monitor a security plan.
Thompson seeks monetary relief of more than $50,000, interest, trial by jury and all other just relief. She is represented by Zachary Leacox and Christopher Murphy of Norden Leacox PLLC in Orlando and Sekou Clarke of The Sekou Clarke Law Group in Orlando.
