TALLAHASSEE, Fla. (Legal Newsline) — A Florida man says he was trying to enjoy trail mix bought at a Leon County Walmart but instead bit down on broken glass.
David Hendrix filed a complaint Sept. 7 in Leon County Circuit Court against John B. Sanfilippo & Son Inc. and Walmart, alleging liability, negligence and other claims.
According to Hendrix's complaint, he purchased a bag of trail mix from Walmart in Tallahassee on Sept. 7, 2022. He claims that while he was eating the trail mix, he realized he was eating pieces of glass that were inside the trail mix bag.
Hendrix alleges he suffered physical impairment, disfigurement, lost wages and incurred medical expenses. He further alleges the defendant's negligence for failing to properly test the product before distribution on the market and for not adequately monitoring the safety and sanitary conditions at its premises.
Hendrix claims the defendants failed to warn of the contaminated trail mix and that they failed to comply with FDA regulatory practices and regulations.
Hendrix seeks monetary relief of more than $50,000, interest, trial by jury and all other just relief. They are represented by Amber Hall in Tallahassee.
