Lawsuit questions 'raw' claims of non-alcoholic kombucha

LOS ANGELES (Legal Newsline) — A proposed class action says "raw" kombucha is not exactly that, because alcohol has been extracted.

Alicia Schneiderman, individually and on behalf of all others similarly situated, filed a complaint Sept. 29 in the U.S. District Court for the Central District of California against Brew Dr. Kombucha LLC, alleging negligent representation and other claims. 

Schneiderman claims in her class action that Brew Dr. Kombucha mislabels its products as being raw, not pasteurized or having not undergone sterile filtration or chemical sterilization. She alleges Brew Dr. Kombucha's products have had natural occurring alcohol extracted, which makes them no longer "raw." 

Schneiderman claims the defendant makes misrepresentations to consumers by labeling its products as "RAW-REAL-REFRESHING." She further claims consumers spend much more on raw and organic products and they purchase the defendant's  products under the "false impression" of misleading advertised benefits. 

Schneiderman and the class seek monetary relief, trial by jury and all other just relief. They are represented by Ryan McBride of The Kazerouni Law Group APC in Phoenix.
