Peacock sued over subscription renewals

NEW YORK (Legal Newsline) — Peacock is facing a class action alleging it illegally automatically renews users' subscriptions. 

Holly Winston, individually and on behalf of all other persons similarly situated, filed a complaint Sept. 15 in the U.S. District Court for the Southern District of New York against Peacock TV LLC alleging violation of California's Unfair Competition Law and other claims. 

Winston claims in her class action that Peacock is illegally automatically renewing subscription plans for its media service. She alleges that Peacock enrolls consumers in a program that automatically renews subscriptions from month-to-month or year-to-year. She further alleges Peacock fails to provide the required disclosures and authorizations under California law to automatically renew the subscriptions. 

Winston alleges Peacock does not provide complete renewal offer terms in a clear and conspicuous manner and deliberately confuses consumers to bolster revenue. She also alleges Peacock fraudulently misrepresents material facts about its subscriptions. 

Winston and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Adrian Gucovschi of Bucovschi Rozenshteyn PLLC in New York and Frederick Klorczyk III of Bursor & Fisher PA in New York.
