Lawsuits

TAMPA, Fla. (Legal Newsline) — A Florida jet ski rental company is facing a negligence claim after a rider suffered severe injuries.

Ana Cristina Merced Toro filed a complaint Aug. 10 in the Hillsborough County Circuit Court against J Water Recreation LLC alleging negligence.

According to Toro's complaint, she was a passenger on a Yamaha Jet Ski in the waters of Tampa Bay in Florida that was rented from J Water Recreation on May 26, 2022. She claims that she was thrown off and struck in the head by another jet ski owned by J Water that was being operated by one of the other renters.

Toro alleges she suffered injuries to her head and other parts of her body. She claims J Water's negligence for allowing the jet ski to be rented by people without any instruction and without completing a state-approved boater safety course, in violation of Florida law. She further claims the defendant failed to provide "on-the water" demonstration to evaluate the renters or display safety information.

Toro alleges J Water also failed to properly monitor and supervise the operation of the rented jet skis. She claims she has suffered pain, mental anguish, lost earnings and incurred medical expenses.

Toro seeks monetary relief of more than $50,000, interest and all other just relief. She is represented by Jacob Munch and Catherine Saylor of Munch and Munch PA in Tampa.
